The Demise of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the introduction of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A American diplomat spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: an extensive attack of rocket attacks on Kyiv.

The Pattern of Diplomacy and Destruction

The chain of contrasting events captured the grim essence of the outgoing year. By day, negotiation efforts are conducted: hopeful statements are issued from different nations. Considerable effort is allocated on restraining certain initiatives. By night, Russian leadership forcefully demonstrates the world that, for them, military action persists as the key method for achieving "peace".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the present situation of Ukraine's vulnerability was laid bare. Ukraine is equipped to monitor rocket firings from enemy soil, a capacity provided through timely intelligence. From observation points, military aircraft that had been scrambled to engage hostile aerial threats roared overhead – sophisticated military planes delivered to Ukraine by Western partners.

Moments later, Kyiv's missile defense thundered: several firings targeted at a incoming threat. This was a sophisticated defense system at work, probably delivered by Western nations. Every launch shakes the surroundings, causing tremors. The moment of terror quickly transforms into sober acceptance: perhaps the approaching threat won't strike its target this time, preventing destruction from ruin and additional electricity failures.

Ongoing Risks

Not long after, a heavy machine gun engaged a drone close by, part of a defensive team – almost certainly allied-provided weaponry. Regrettably, the bullets missed the opposing UAV – it maintained course toward its target.

Periodically, this continued until dawn. Kyiv awoke to the morning news: multiple fatalities, damage and infrastructure problems in numerous residences as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – experiencing conflict. But those entire period illustrated Ukraine's critical military reliance on international aid – a dependence that regional partners are clearly incapable to replace in the short term.

Ineffective Peace Efforts

The detailed framework from Washington provoked deep reactions, debate and deep concern – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new initiative from American administration unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This pattern will, no doubt, endure.

Political Considerations

It is convenient to criticize particular leaders of repeatedly advocating Russian terms. But that does not seem to be the whole story. Washington works based on a premise understood by experienced diplomats: you cannot achieve through diplomacy what you have failed to defend militarily. The American government believes that it is impossible to pressure the Kremlin to relinquish the areas that it already controls in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, US leadership does little to deter Moscow, through statements or actions, from believing that the current condition will not evolve additionally in its favour in the months ahead.

Conflicting Perspectives

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its supporters are coming close to fatigue. Their incentive to agree to terms that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to stop fighting, but they will continue as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing lives and land but preventing a total frontline collapse until circumstances change in its favour.

Existing Situation

Objectively, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: political desires to mediate resolution and achieve global acclaim, and the government's double obstacles – on one hand, not to distance important partners, and on the other, to unite the population around the country's interests against any proposal Kyiv finds unsuitable, so that their priority does not shift toward domestic problems. And although their mission will now be much harder after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Summary and Prospects

It took a only one week to kill the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the other European countries, along with calming attempts of negotiators, and finally, current information leaks, all served their function.

While new plans based on old ideas are forthcoming, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and reflect particular unwillingness to change the course of events, if they stand together and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the foreseeable future, primarily depend on sustained allied backing.
